Since the broadened saving obligation of 2023, the largest energy users in the Netherlands carry a heavier duty than other businesses. Think of a large production site, a data centre or a factory with energy-intensive processes. They are expected not only to take the easy savings, but to actively map how they can structurally lower their energy use and carbon emissions. The investigation obligation formalises this and lets the competent authority follow along.

What does the investigation obligation involve?

The investigation obligation requires you to systematically examine which measures reduce your energy use and carbon emissions. You look at activity-related measures, such as more efficient electric drives, and at using residual heat. You report the measures that pay back within five years, but the obligation also pushes you to look further at CO2 reduction, for example by generating renewable energy or switching to an energy carrier with lower emissions. This produces a substantiated picture of your options. The report has fixed components, including an analysis of the electric drive systems and a comparison against a list of recognised measures. You report once every four years.

Who does the investigation obligation apply to?

The investigation obligation applies to large energy users: locations with an annual energy use from 10 million kilowatt-hours of electricity or 170,000 cubic metres of natural gas equivalent. In addition, it must concern an activity for which the national government sets the environmental rules under the Environmental Act, a so-called environmentally harmful activity. The legal basis is the Environmental Activities Decree (Besluit activiteiten leefomgeving), which has fallen under the Environmental Act since 1 January 2024. If your location uses less, but more than 50,000 kilowatt-hours of electricity or 25,000 cubic metres of natural gas, the general energy-saving obligation applies and you report via the notification obligation. The investigation obligation is therefore the heavier variant for the largest users.

What is the difference with the notification obligation?

The notification obligation and the investigation obligation are two ways to report on the energy-saving obligation, but they differ in depth. With the notification obligation you take the Recognised Measures List as a starting point and state per measure whether you have carried it out. That is mainly a checklist exercise based on a fixed list. The investigation obligation asks for more: you carry out your own investigation, map your processes and demonstrate which measures are feasible, including CO2 reduction. The notification obligation also covers building measures such as insulation; the investigation obligation focuses on the activities and processes. Large users can face both obligations, each for a different part of their location.
